1. Acceptance of Terms
By accessing or using SkoposGuard (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.
2. Description of Service
SkoposGuard provides cybersecurity monitoring, alerting, automation, and related services designed to assist organizations in identifying and responding to potential security events.
The Service is provided as a tool to assist users and does not guarantee the prevention, detection, or remediation of all security incidents.
3. No Warranty of Security
YOU ACKNOWLEDGE AND AGREE THAT:
- No cybersecurity solution is 100% effective.
- SkoposGuard does not guarantee detection or prevention of all threats.
- Users remain solely responsible for their own security posture, policies, and actions.
4. Customer Responsibilities
You agree that you are responsible for:
- Maintaining the confidentiality of your credentials
- Configuring and managing your environment securely
- Reviewing alerts and taking appropriate action
- Ensuring compliance with applicable laws and regulations (e.g., HIPAA, SOC 2, etc.)
Failure to act on alerts or recommendations is solely your responsibility.
5. Third-Party Integrations
The Service may integrate with third-party platforms including but not limited to Microsoft 365, Azure, and others.
We are not responsible for:
- Availability, accuracy, or security of third-party services
- Changes made by third-party providers
- Data loss or exposure caused by third-party systems
6. Data Processing & Privacy
By using the Service, you authorize SkoposGuard to process logs, metadata, and security-related information necessary to provide the Service.
We do not guarantee:
- Completeness of collected data
- Continuous ingestion of logs
- Accuracy of external data sources (e.g., geo-IP)
7. False Positives and False Negatives
The Service may generate:
- False positives (benign events flagged as threats)
- False negatives (actual threats not detected)
SkoposGuard shall not be liable for any damages resulting from either.
8. Automation & Actions
Certain features may allow automated actions (e.g., account lock, password reset).
You acknowledge:
- These actions may impact business operations
- You are responsible for enabling, configuring, and reviewing automation
SkoposGuard is not liable for business disruption caused by automated actions.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
SkoposGuard shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business interruption
- Security breaches, cyberattacks, or unauthorized access
TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE LAST 3 MONTHS.
10. Indemnification
You agree to indemnify and hold harmless SkoposGuard from any claims, damages, or liabilities arising from:
- Your use of the Service
- Your failure to follow security recommendations
- Your violation of laws or regulations
11. Service Availability
We do not guarantee:
- Continuous uptime
- Real-time alerting
- Immediate processing of data
Maintenance, outages, and delays may occur.
12. Termination
We may suspend or terminate access:
- For violation of these Terms
- For security risks
- At our discretion with or without notice
13. Intellectual Property
All rights, title, and interest in the Service remain the property of SkoposGuard.
You may not:
- Reverse engineer
- Copy or resell the platform without authorization
14. Compliance Disclaimer
SkoposGuard is not a compliance certification tool.
Use of the Service does not guarantee compliance with:
- HIPAA
- SOC 2
- CMMC
- Any regulatory framework
15. Governing Law
These Terms shall be governed by the laws of the State of [Insert State], United States.
16. Dispute Resolution
Any disputes shall be resolved through binding arbitration. Class action lawsuits are waived.
